Why Did I Serve 16 Years for Murder When I Didn't Kill Anyone? | NYT Opinion

  • In 2003, Adnan Khan committed a robbery in which one of his accomplices unexpectedly killed their victim. The prosecutors, judge and jury all agreed Khan did not plan or commit the murder. Yet he was still sentenced as if he had — and given a life sentence.
    The reason is the felony murder rule, an arcane piece of legal doctrine that allows all accomplices to be held equally responsible for deaths that happen in the committing of a felony.
    Researchers estimate as many as one in five people serving long life sentences did not actually kill anyone.
    In this video Op-Ed, Khan argues that it is time for the felony murder rule to be changed in every state, as it was in California last year. One of the basic principles of a fair justice system is that you are punished for the crimes you commit, not those committed by other people.

        Stopped at 3:22 .....Dude, by your argument shop keeps and homeowners should just lay down for criminals much like yourself and not defend their lives and property. If you're stupid enough to go with a buddy into a dangerous situation and someone dies including your buddy, you're right the killer should be held responsible. How by your logic would this happen? The cops are not responsible for your stupidity, neither is your victim. Ultimately your buddy is responsible for his death, but the next best thing is his partner in crime. Also if your buddy kills the person you're robbing of course you should be held responsible for that, it's a foreseeable outcome of your activities.

        The felony murder rule is great, sorry you went to prison, but you pretty much got what you deserved. At least you didn't end up like your victim...

        Also ignorance of the law is never an excuse. Know the laws of your land bud.

If you have no intent to commit a murder why should you be in prison for someone else’s mistake. “Sounds fair” even the people who enforce the law agree is stupid, so i dont know if you’re trying to be different or whatever but i would like to see you in his place even for a year i know you would change your mind real fast so dont be coming with that bs.

                                                  I don’t think the law is wrong, just don’t commit felonies😐... tbh it’s crazy that this guy is defending committing felonies and it’s even crazier that people are agreeing with him like how would you feel if your child was killed while someone was committing a felony? If that person hadn’t committed that felony your son or daughter would still be alive so them getting charged with murder is them getting what’s coming to them..🤷‍♀️

                                                        god bless this man and so many other people that have been convicted for crimes that they didn't commit. 16 years is more than enough time to learn a lesson about not committing a robbery. The US justice system is so corrupt and focused on profit rather than actual justice.

                                                            i Know is though, but if this rule would be masively known by population, at least 5% les crimes would be committed, specially weapons involved wich would translate in a greater percentage of deaths. if rule gets changes accomplices should still be punished if someone gets killed, maybe not for murder, but getting 15 to 30 for "murder accomplice" instead of "Murder"should be fair, at least if the victim is the one who dies, I don't agree if the partner in crime is the one who dies, but again all this would make felons think twice if they know and start looking for a job like decent people do.

                                                              See, here's where I disagree. If you're both partners in crime at the start, even if you "failed" to see any possible way of accidentally murdering someone, you are still both held responsible. Now, if it was nobody you knew, and you were alone at a liquor store minding your own business when someone got murdered, sure, I'd agree with you. Do you get my point? You're pussying out when it's convenient for you and pretending like it's only your partner's fault despite agreeing to be partners in crime and commit a literal crime TOGETHER.

                                                                Crimes that are non-violent should be met with fines, crimes that are violent should be met with jail time, any crime a person does only applies to affiliates that expected the crime be done; for example people can expect to rob a place, but not expect someone to commit murder. That’s my theory on what the basis of all laws regarding crimes should be.

                                                                        Maybe it shouldn't be life in prison, but i think it's totally fair to blame a death on them when it was their actions that led to their death. They knew what they were doing when they committed the felony, and they should take responsibility what their actions caused.
